Please read these Terms of Service ("Terms") carefully before using the CornerSense mobile application (the "App") operated by CornerSense ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.
2. Description of Service
CornerSense is a boxing timer and interval timer application designed for fighters, athletes, and fitness enthusiasts. The App provides customizable round timers, workout profiles, training statistics, and related features. Your onboarding responses are stored on our servers; all other data (workouts, sessions, notes, preferences) is stored locally on your device.
3. Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.
4. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms. This license does not allow you to:
- Copy, modify, distribute, sell, or lease any part of the App or its content.
- Reverse engineer, decompile, or disassemble the App or attempt to extract the source code.
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
- Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices in the App.
5. In-App Purchases and Subscriptions
CornerSense may offer premium features through in-app purchases or subscriptions. All purchases are processed through Apple's App Store and are subject to Apple's terms and conditions. Prices are displayed prior to purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your Apple ID account settings.
6. Health and Safety Disclaimer
CornerSense is a timer and tracking tool and does not provide medical, health, or fitness advice. The App is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting any new exercise program. You assume all risks associated with your use of the App during physical training activities.
7. Intellectual Property
The App and all of its content, features, and functionality — including but not limited to text, graphics, logos, icons, sounds, and software — are owned by CornerSense and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content in the App without our prior written consent.
8. User Data
Your onboarding responses (name, gender, training goals) are stored on our servers. All other user data — including workout profiles, session history, notes, and personal preferences — is stored locally on your device and is not transmitted to our servers. You are solely responsible for backing up your device to prevent loss of locally stored data. For more information, please refer to our Privacy Policy.
9. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
10. Limitation of Liability
To the maximum extent permitted by applicable law, CornerSense and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or related to your use of the App, regardless of the theory of liability.
11. Indemnification
You agree to indemnify, defend, and hold harmless CornerSense and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App or violation of these Terms.
12. Termination
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately. You may terminate your use of the App at any time by deleting it from your device.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms within the App or on our website. Your continued use of the App after any changes constitutes your acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
